Preamble
The services offered by the simplified joint-stock company (Société par Actions Simplifiée) SAS Corse Bagagerie, registered with the Ajaccio Trade and Companies Register under number Ajaccio 994 797 454, VAT number: FR67994797454, with its registered office at 27 Rue Paul Colonna d'Istria, 20900 Ajaccio, France, are governed by these general terms and conditions.

Article 1 – Purpose
1.1These general terms and conditions of sale (hereinafter "GTC") govern the provision of automated lockers for luggage storage, hereinafter referred to as "Storage", in a secured area located at 2 Rue Sebastiani, 20000 Ajaccio, France, for variable durations.
Article 2 – Storage conditions
2.1Booking and management of the Storage are handled directly online via the website bagagerie-ajaccio.fr or on-site via the touch-screen kiosk provided. The customer must create a booking, online or via the kiosk, to access the service.
2.2SAS Corse Bagagerie ensures the safekeeping and preservation of luggage deposited in the lockers throughout the duration of the booking.
2.3The Storage service offered by SAS Corse Bagagerie is intended for persons over 18 years of age and is prohibited to unaccompanied minors. When booking, the customer declares on their honour that they are of legal age or accompanied by a responsible adult; as no identity check is carried out, any false declaration is the sole responsibility of the customer.
2.4The customer has exclusive use and unlimited access to their locker(s) for the entire duration of their booking. The service is accessible 24/7. Secured access with prior booking is required between 10 pm and 8 am.
Article 3 – Permitted and prohibited items
3.1The customer undertakes not to store any unlawful, dangerous or perishable items in the locker. Permitted items, within the capacity of the locker, include suitcases, baskets, handbags, travel bags and similar items, keys, personal effects, personal documents for everyday use...
3.2Luggage must be properly closed.
3.3 – List of items prohibited from storage
Any goods or materials that are easily flammable, dangerous, perishable, give off offensive smells, or are likely to damage the infrastructure of the luggage storage facility or other items in storage.
Any means of payment, cash, securities, or transferable securities.
Jewellery, precious metals, works of art.
Official, commercial, business, manuscript or travel documents.
Any content whose cumulative value per locker exceeds €750, it being specified that the company's liability and any indemnification are capped at this amount per locker (see articles 4.7 and 9.1).
Luggage weighing more than 25 kg.
Animals, plants or any other living species.
Items prohibited by law or considered dangerous under applicable legislation, or items which, due to their nature or packaging, could cause damage to persons or the environment.
Any material that may be considered pornographic or indecent.
Explosives, firearms and bladed weapons.
Any stolen or illegally held item.
Narcotic or psychotropic drugs and any illegal substance.
3.4SAS Corse Bagagerie disclaims all liability in the event of the deposit in the lockers of any item prohibited from storage under the list of prohibited items above.
3.5SAS Corse Bagagerie reserves the right to open a locker in the event of a suspicion of unlawful or dangerous content.
Article 4 – Liability
4.1SAS Corse Bagagerie undertakes to take all necessary measures to secure the lockers and prevent any risk of theft or damage. The premises are equipped with video recording active 24/7. Support (French/English) is available during opening hours. Remote unlocking of the lockers is possible in case of emergency.
4.2The customer must ensure that the locker is properly locked when depositing their luggage and that nothing is left behind upon retrieval.
4.3SAS Corse Bagagerie cannot be held liable for any loss, theft or damage to luggage resulting from the customer's failure to lock the locker when depositing or accessing it, or from any oversight upon final retrieval of the luggage.
4.4The customer is responsible for the content of their luggage and declares to have read the list of permitted and prohibited items. SAS Corse Bagagerie cannot be held liable should prohibited items or products nevertheless be placed in storage by the customer on its premises.
4.5The customer is responsible for selecting their locker. They must ensure that the size of their luggage matches the size of the locker chosen before validating their booking. The dimensions are displayed on the website bagagerie-ajaccio.fr and on the touch-screen kiosk.
4.6The customer is liable for any damage caused to the lockers and must reimburse the costs of repair or replacement.
4.7The liability of SAS Corse Bagagerie in the event of theft, loss or damage to items deposited in the lockers is capped at seven hundred and fifty (€750) euros per locker, save in the event of gross negligence (faute lourde) or wilful misconduct (faute dolosive) duly proven against it, or the exclusions of liability set out in articles 4.2 and 4.3.
4.8SAS Corse Bagagerie shall under no circumstances be held liable for any loss, theft or damage to luggage forgotten or left unattended by its owner after the locker has been opened, or left in the premises.
Article 5 – Procedure for depositing and retrieving luggage
5.1 – Procedure for depositing luggage
By validating payment of their storage, the customer declares that their luggage does not contain any prohibited items (see list of prohibited items).
Online booking:
1. The customer completes their booking on the website bagagerie-ajaccio.fr by choosing the locker size and storage duration.
2. Once payment is validated, the customer receives a unique access code by email and SMS.
3. The customer visits the premises and uses their code to unlock the locker.
4. After loading their luggage, the customer closes the locker door, making sure it is properly locked.
5.2 – Procedure for retrieving luggage
To retrieve their luggage, the customer uses their access code to unlock the locker. If the initial storage duration is exceeded, the customer must pay the additional amount before retrieving their luggage.
The customer must ensure that nothing is left in the locker. In the event of difficulty, the customer may contact support via the number displayed on the premises or on the website.
Article 6 – Abandoned luggage
6.1If luggage is not retrieved more than 24 hours after the end of the initial storage period, it will be deemed Abandoned.
6.2SAS Corse Bagagerie will open the locker and keep the luggage on its premises for a maximum period of 30 days. After this period, it will be handed over to the competent authorities (lost property service).
6.3During this 30-day period, the customer may contact SAS Corse Bagagerie by email at contact@bagagerie-ajaccio.fr to arrange the return of their luggage.
6.4Flat administration fees of €30 and storage fees of €5 per day (starting from and including the day the luggage is deemed "Abandoned") will be charged in addition to the late-retrieval rate. Luggage will only be returned to its owner after full payment.
Article 7 – Pricing and payment
7.1Storage rates are inclusive of all taxes (VAT included) and clearly displayed on SAS Corse Bagagerie's website. They are subject to change without notice. The rates in force on the day of booking are available on the website bagagerie-ajaccio.fr and on the touch-screen kiosk.
7.2Payment is due at the time of locker booking. Accepted means of payment are as follows:
• Online: bank card (CB, Visa, Mastercard), Apple Pay, Google Pay and PayPal.
• On the on-site kiosk: contactless bank card only (including Apple Pay, Google Pay and Samsung Pay via compatible phone).
In the event of payment failure, for any reason whatsoever, the booking is not effective.
7.3Storage packages chosen and validated by the customer may be modified or cancelled under the conditions and within the deadlines set out in article 8 – CANCELLATION AND REFUND. Rates vary according to the locker size and the package chosen.
7.4Any storage package chosen and validated by the customer at the time of booking is payable in full, even if the customer retrieves their luggage early.
7.5The pricing automatically applied as a result of late retrieval of luggage is payable and no discount or refund (even partial) may be granted.
Article 8 – Cancellation and refund
8.1 – Standard policy (included with every booking)
For any booking, the customer may cancel or modify their booking free of charge up to 7 days (D-7) before the start date and time of the rental. Within this period, cancellation entitles the customer to a full refund of the amount paid.
After this period (between D-7 and the start time of the rental), no cancellation is possible under the standard policy, and no refund, even partial, will be made.
8.2 – Booking modification
Any modification made up to D-7 is free of charge. In the event of a modification leading to a change in price (change of duration, locker size, etc.), the customer pays or is refunded the difference in price.
After D-7, modifications remain possible but will not give rise to any refund, even partial, in the event of a modification leading to a lower price. Any modification leading to a price increase must be paid for by the customer.
8.3 – Optional "Free cancellation and modification" (optional)
At the time of booking, the customer may subscribe, for a flat fee of €1.50, to an optional "Free cancellation and modification" feature which extends the standard cover to the period between D-7 and the start time (H) of the rental.
With this option, the customer may, at any time before the start of their rental:
• cancel their booking and obtain a full refund of the amount paid;
• modify their booking free of charge, the customer paying or being refunded only any difference in price.
In the event of cancellation giving rise to a refund, the amount of the option (€1.50) is also refunded to the customer. The option is personal and attached to the booking.
8.4 – Refund terms
Any refund is credited back to the means of payment used at the time of booking, within a maximum of 15 days from the confirmation of the cancellation or modification.
As an exception, for payments made on-site at the touch-screen kiosk via electronic payment terminal (EPT), the refund will be made by bank transfer. The customer must provide bank account details (IBAN) at contact@bagagerie-ajaccio.fr. The 15-day period runs from the date of receipt of the IBAN.
Article 9 – Insurance
9.1SAS Corse Bagagerie maintains insurance covering the risks related to its activity, in accordance with legal requirements. The contents deposited are covered up to €750 per locker, excluding any items prohibited from storage and subject to the customer's compliance with these GTC, as well as upon presentation of proof of purchase.
9.2Customers are encouraged to take out personal insurance to cover valuables they choose to store in the lockers.
9.3In the event of a claim, the customer shall immediately notify SAS Corse Bagagerie by email at contact@bagagerie-ajaccio.fr, stating their name and booking number.
9.4Claims and requests for compensation, together with all proofs of purchase, must be sent by email to contact@bagagerie-ajaccio.fr within a maximum of 3 days from the time the loss was observed.
Article 10 – Security and confidentiality
SAS Corse Bagagerie implements all necessary measures to ensure the security of transactions and the confidentiality of customers' personal data.
By accepting these General Terms and Conditions, the Customer and SAS Corse Bagagerie undertake to comply with the terms and conditions of personal data protection. SAS Corse Bagagerie takes the appropriate measures to ensure the protection and confidentiality of personal data it holds or processes in compliance with the provisions of the GDPR.
10.1 – Need for collection
The Customer provides SAS Corse Bagagerie with certain personal data necessary for the provision of the requested Service, namely: surname, first name, email address, telephone number.
10.2 – Retention period
All personal data collected is processed and kept for a period of 5 years from the retrieval of the luggage. Upon expiry of the retention periods, the data is permanently deleted or anonymised.
10.3 – Recipients of the data
The customer's personal data is not transmitted to third parties for commercial purposes without consent.
10.4 – Customer rights
In accordance with applicable regulations, the customer has the right to access, rectify, object to, restrict processing of, erase and port the information, which can be exercised by sending a request directly to contact@bagagerie-ajaccio.fr.
In the event of any difficulty relating to the management of their personal data, the customer may lodge a complaint with the French data protection authority (CNIL) or any other competent authority.
Article 11 – Modifications to the general terms and conditions
11.1SAS Corse Bagagerie reserves the right to modify these GTC at any time. Modifications will come into effect immediately upon publication on SAS Corse Bagagerie's website.
Article 12 – Disputes
12.1In the event of a dispute, the customer is invited to contact SAS Corse Bagagerie's customer service to seek an amicable solution.
12.2Failing an amicable resolution, any dispute shall be submitted to the competent court in accordance with the provisions of French law.
12.3The consumer customer may have free recourse to a consumer mediator with a view to amicably resolving the dispute, in accordance with articles L.611-1 et seq. of the French Consumer Code.
Article 13 – Right of withdrawal
13.1The luggage storage service constitutes a service for the rental of goods with a specified date of performance. As such, and in accordance with article L221-28 12° of the French Consumer Code, it is expressly excluded from the fourteen (14) day right of withdrawal set out in articles L221-18 et seq. of the same code.
13.2By validating their booking, the customer acknowledges having been informed of this exclusion and expressly waives any right of withdrawal.
13.3The conditions for cancellation and modification of the booking are governed by articles 8.1 to 8.3 of these GTC.
Article 14 – Acceptance of the general terms and conditions
14.1Use of SAS Corse Bagagerie's services implies full acceptance of these GTC. The customer acknowledges having read the GTC before any booking and declares that they accept them without reservation.
Article 15 – Governing law and language
15.1These General Terms and Conditions are governed by French law.
15.2All disputes which could not be settled amicably between SAS Corse Bagagerie and the Customer shall be submitted to the competent courts under the conditions of common law.
15.3These GTC are drafted in French. Should they be translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
